MowZansi PAIA Manual

This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"). It explains, in plain language, what records MowZansi holds, which records you can get without a formal request, how to request access to a record, when access may be refused, what it costs, and what you can do if your request is refused.
MowZansi is a South African platform that connects customers who need garden and lawn services with independent providers who perform those services. This manual describes the records we hold for the platform.

MowZansi is a sole proprietorship. There is no company, no registration number and no board of directors. The proprietor is both the head of the body and its Information Officer.
2. The guide on how to use PAIA
PAIA requires the Information Regulator of South Africa to publish and update a guide on how to use the Act. The guide explains, in plain language, how members of the public can exercise their rights under PAIA and how to request access to a record. The guide is available from the Information Regulator:

You may use the Regulator's guide and the prescribed request form when asking us for a record. Where you cannot use the guide or would prefer to deal with us directly, you may send your request to our Information Officer as set out in section 6.
3. Records available without a formal request
The following records are available without a formal PAIA request, free of charge, from our website or on request from the Information Officer:
- this PAIA manual;
- our Privacy Policy and our Terms of Service;
- general information about the MowZansi platform, the services it offers and provider subscription plans;
- our business and contact details.
4. Records available under other legislation
Some of the records we hold are also governed by, and in some cases accessible under, legislation other than PAIA. Where a record is available under another law, we may refuse a PAIA request for it because the record is already reasonably accessible (see section 7).
- Your own personal information may be requested under POPIA (section 23), by contacting our Information Officer.
- Tax and accounting records are kept and made available as required by the Tax Administration Act 28 of 2011 and the Income Tax Act 58 of 1962. Confidentiality of taxpayer information applies.
- Electronic transaction and consumer records are kept as required by the Electronic Communications and Transactions Act 25 of 2002 and the Consumer Protection Act 68 of 2008.
5. Subjects and categories of records we hold
The subjects of the records we hold are:
- Customers - homeowners and other users who book garden and lawn services through the platform.
- Providers - independent garden and lawn-service businesses that offer and perform services through the platform.
- Other persons whose information appears in the records described below, such as a person named in correspondence or a dispute.
The categories of records we hold are set out below.

6. How to request access to a record
To request access to a record we hold:
- Use the prescribed form. The prescribed request form is Form 2, published by the Information Regulator with the PAIA regulations (https://inforegulator.org.za).
- Send it to our Information Officer (details in section 1):

- Identify the record clearly. Give us enough detail to find it, such as the subject of the record, the category of record (see section 5), relevant dates, and any account, booking or reference number.
- Identify the right you are exercising. Tell us whether you are requesting access as a data subject exercising your rights (for example under POPIA section 23) or under PAIA generally.
- State the form of access you want, for example a copy of the record or an opportunity to inspect it.
- Pay any prescribed request fee. A request fee may be payable, and an access fee may be payable if access is granted (see section 8).
Timelines. Once we receive a request that complies with the requirements:
- we must decide on the request within 30 days of receipt, unless the law allows us to extend that period (for example for a large volume of work);
- we will notify you of the decision, and if access is granted we will tell you the access fee payable;
- if we do not decide within the time allowed, the request is treated as refused; and
- we may ask you to verify your identity before we act.
7. Grounds on which access may be refused
Access to a record may be refused in the following circumstances, described in plain language:
- Another person's privacy. The record contains personal information about another person, and disclosing it would unreasonably invade that person's privacy.
- Another party's commercial information. The record contains a third party's trade secrets or its financial, commercial, technical or scientific information, and disclosing it would likely harm that party.
- Confidential information. The record was given to us in confidence by someone else, and disclosing it would breach that duty of confidence.
- Safety and property. Disclosing the record would endanger someone's life or physical safety, help the commission of an offence, or harm property.
- Privileged records. The record is privileged from production in legal proceedings, such as attorney-client communications.
- Our own commercial information. The record is our own trade secret or financial, commercial, technical or scientific information, and disclosing it would likely harm MowZansi commercially.
- Already accessible. The record is already publicly available, or is available under another law (see section 4).
- Frivolous or vexatious requests. The request is frivolous, vexatious, or manifestly unreasonable.
- Record not held. We do not hold the record, or we cannot find it after a reasonable search.
- Prohibited by law. Another law prohibits or restricts disclosure of the record.
Even where a ground for refusal applies, PAIA requires disclosure where the public interest in disclosing the record clearly outweighs the harm that disclosure would cause.
8. Prescribed fees
A request fee and, where access is granted, an access fee may be payable, as prescribed in the PAIA regulations. The prescribed fees may cover the request, searching for and preparing the record, copying or transcription, and postage. We will tell you the fees payable before or as required by law, and we will not charge more than the prescribed amounts.
9. Remedies if access is refused
If your request for access is refused (including where we fail to decide within the time allowed, which is treated as a refusal), you may:
- Lodge an internal appeal. For a private body, an internal appeal is lodged with the head of the body within 60 days of the decision.
- Apply to a court for appropriate relief within the period set by PAIA.
- Complain to the Information Regulator about the refusal and about our compliance with PAIA. Contact details are in section 2.
