MowZansi Terms of Service

These Terms of Service ("Terms") govern your use of the MowZansi platform. Please read them carefully. By creating an account or using MowZansi, you agree to these Terms.


1. About us and supplier disclosures

The following disclosures are made in terms of section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"):

We are the provider of the MowZansi platform. Our privacy practices are described in our Privacy Policy, available at https://mowzansi.co.za/privacy.

2. What MowZansi is

MowZansi is a South African online platform that connects customers who need garden and lawn services with independent providers who offer them. Customers use MowZansi to find and book mowing jobs. Providers accept and perform those jobs and pay a monthly subscription to use the platform.

MowZansi provides the platform only. We are not a garden or lawn-services business, and we do not perform the work ourselves.

Customers use the platform to book services. Customers do not pay a subscription to use the platform. Customers agree to pay the price shown for a booking and to provide accurate job information.

Providers are independent businesses that perform the services. Providers pay a monthly subscription (see section 6) and agree to the provider obligations in section 8.

12. Disputes between customers and providers

If a customer and a provider disagree about a job (for example, about quality, completion or payment), they should first try to resolve it between themselves. The platform records dispute information, including who raised the dispute and the reason. MowZansi may, at its discretion, help facilitate a resolution, but we are not obliged to resolve the dispute and we are not the arbitrator. Legal rights between the customer and the provider are not affected.

14. Intellectual property

The MowZansi name, logo, platform, software, design and content are owned by us or our licensors and are protected by law. You may use the platform only as these Terms allow. You may not copy or reuse our intellectual property without our written permission. Content you upload remains yours; you give us a licence to use it to operate the platform.

15. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including under the CPA or POPIA.

16. Indemnity

You indemnify MowZansi against claims, losses and costs (including reasonable legal costs) arising from your use of the platform, your breach of these Terms, or your unlawful conduct, except to the extent caused by our own fault.

Nothing in these Terms is intended to limit any right you have under South African consumer law, including the CPA and ECTA. Where these Terms conflict with a right you have under law that cannot be waived, the law prevails. ECTA also gives you rights about the conclusion and cancellation of electronic transactions.

19. Amendments

We may update these Terms from time to time. The version and effective date at the top will change. Material changes will be notified by email and by posting them on the site, and take effect 14 days after that notice. Continued use after an update means you accept the updated Terms.

20. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have jurisdiction, subject to any right you have to refer a consumer complaint to a relevant consumer body or ombud.
